New York's "Serious Injury" Threshold
In New York, you can only sue for pain and suffering in car accident cases if your injury meets the "serious injury" threshold defined in Insurance Law §5102(d). This includes:
- Death
- Dismemberment
- Significant disfigurement
- Fracture (any bone break)
- Loss of a fetus
- Permanent loss of use of a body organ, member, function, or system
- Permanent consequential limitation of a body organ or member
- Significant limitation of a body function or system
- Medically determined injury preventing usual activities for 90+ days within 180 days of the accident
